1. Legal warranty of conformity
All products marketed by MGY OÜ are covered by the 3-year legal warranty of conformity from the date of delivery, pursuant to Article 120 of Spanish Royal Legislative Decree 1/2007, as amended by Royal Decree-Law 7/2021 transposing Directive (EU) 2019/771.
During this period, the consumer has the right to have the product brought into conformity at no cost through repair or replacement, or, where applicable, to a price reduction or to terminate the contract.
2. What does the warranty cover?
The warranty covers any lack of conformity of the product, meaning any deviation from:
- The description, type, quantity, quality, functionality and suitability described in the contract.
- The use to which the consumer intends to put the goods and which has been communicated to the seller.
- The customary qualities of goods of the same type that the consumer can reasonably expect.
- The quality and characteristics of the product presented as a sample or model.
3. What does the warranty NOT cover?
The warranty does not cover defects arising from:
- Inadequate use, negligence, or accident.
- Modifications, repairs, or interventions by unauthorised personnel.
- Incorrect electrical connection, voltage spikes without adequate protection, or use with voltages other than those specified by the manufacturer.
- Normal wear and tear of consumable parts (turntable styli, headphone pads, fuses, etc.) beyond their foreseeable lifespan.
- Cosmetic damage arising from normal use.
- Force majeure events (floods, fires, atmospheric electrical discharges).
4. Presumption of non-conformity
Unless proven otherwise, any lack of conformity manifesting in the first two years from delivery shall be presumed to have existed at the time of delivery, except where this presumption is incompatible with the nature of the product or the nature of the lack of conformity (Art. 121.2 RDLeg 1/2007).
5. Period for reporting the lack of conformity
The consumer must inform the seller of the lack of conformity within 2 months of becoming aware of it, pursuant to Article 124 of RDLeg 1/2007. Failure to comply with this period does not entail loss of the right to remedy, but the consumer shall be liable for any damage actually caused by the delay in notification.
6. Commercial warranty from the manufacturer
In addition to the legal warranty, the manufacturers represented by MGY OÜ (Cary Audio, Chord Electronics, PMC, Fyne Audio, Meze Audio, Gold Note, Chord Company, MJ Acoustics, Acoustic Signature, Lehmannaudio, Rekkord Audio, among others) may offer additional commercial warranties with specific conditions, which may require registering the product on the manufacturer's website. The conditions of each commercial warranty are specified in the product documentation.
The manufacturer's commercial warranty does not replace or limit the consumer's legal rights against the seller.
7. How to claim warranty
- Contact us at info@mgy-europe.com providing:
- Order number and contact details.
- Detailed description of the problem.
- Product serial number.
- Photos or videos illustrating the issue, when possible.
- We will indicate the steps to follow, which may include sending the product to the manufacturer's official service centre or to our facilities for evaluation.
- Shipping costs to the service centre, when the lack of conformity is recognised, shall be borne by MGY OÜ.
8. Repair or replacement times
The repair or replacement of the product shall be carried out within a reasonable time and without major inconvenience to the consumer, pursuant to Article 118 RDLeg 1/2007. The time will depend on the nature of the fault, the availability of parts, and the manufacturer's service centre times. We will keep you informed throughout the process.
9. Keeping documentation
To exercise your warranty rights, we recommend keeping:
- The invoice or purchase receipt.
- The original packaging (especially useful for shipments to the service centre).
- The manufacturer's warranty card, where applicable.
