General Terms and Conditions of Sale

1. Seller identification

2. Scope of application

These General Terms and Conditions regulate the sale of products offered on the website to consumers resident in Spain, within the meaning of Article 3 of Royal Legislative Decree 1/2007. Placing an order constitutes express acceptance of these terms, as well as of the Privacy Policy and the Cookie Policy.

3. Products and prices

The products offered are high-fidelity (Hi-Fi) audio equipment and related accessories from the brands represented by MGY OÜ: amplifiers, loudspeakers, turntables, phono stages, DACs, streamers, headphones, cables, accessories, and professional equipment, among other categories. The technical features and specifications are detailed on each product's page.

The images are illustrative; minor variations from the delivered product may exist due to manufacturer updates or display device characteristics.

All prices shown are in euros (EUR) and include applicable VAT under the European Union One-Stop-Shop (OSS) regime. Shipping costs are shown separately before completion of the order.

MGY OÜ reserves the right to modify prices at any time, although products will be invoiced at the price in force at the time of order confirmation.

4. Purchase process

1. Selection of products and addition to the cart.
2. Customer identification and completion of shipping and billing details.
3. Selection of shipping and payment method.
4. Order review, acceptance of the General Terms, and confirmation.
5. Order confirmation by email, which constitutes proof of the contract. The contract is concluded in Spanish and/or English.

The consumer can identify and correct data entry errors before final order confirmation.

5. Payment methods

The following payment methods are accepted: credit/debit card (Visa, Mastercard) via secure gateway, and other methods indicated during the purchase process. MGY OÜ does not store full card details; processing is carried out by PCI-DSS certified providers.

6. Availability

Product offerings are subject to availability. For high-end products or limited editions, additional procurement time may be required, which will be indicated on the product page or in the order confirmation. If a product is unavailable after the order has been placed, the customer will be informed by email and a full refund will be processed within a maximum of 14 calendar days.

7. Shipping

Shipping conditions, zones, times, and costs are detailed on the Shipping page, which forms an integral part of these Terms.

8. Right of withdrawal

The consumer has the right to withdraw from the contract within 14 calendar days of receipt of the product, without justification and without penalty, in accordance with Royal Legislative Decree 1/2007 and Directive 2011/83/EU.

9. Legal warranty

Products are covered by the 3-year legal warranty of conformity from delivery, pursuant to Article 120 of Royal Legislative Decree 1/2007, amended by Royal Decree-Law 7/2021. Details are set out on the Warranty page.

10. Liability

MGY OÜ is liable for the non-conformity of products under the terms provided by Spanish and European consumer law. To the extent permitted by law, the liability of MGY OÜ is limited to the price of the product purchased. We are not liable for indirect damages, lost profits, loss of data, or improper use of products by the consumer.

The liability limitations in this clause do not apply in cases of wilful misconduct, gross negligence, or where a mandatory Spanish rule prevents it.

11. Dispute resolution

The consumer can direct any claim to info@mgy-europe.com. In accordance with Regulation (EU) 524/2013, the European Commission provides an Online Dispute Resolution platform available at: https://ec.europa.eu/consumers/odr.

12. Applicable law and jurisdiction

The contract is governed by the laws of the Republic of Estonia, without prejudice to the application of the mandatory consumer protection rules of the country of habitual residence of the consumer (Article 6 of the Rome I Regulation). For consumers resident in Spain, the competent courts shall be those of the consumer's place of residence.

13. Modification of terms

MGY OÜ reserves the right to modify these General Terms. Modifications will be published on this page and shall apply to orders placed after their publication.
